What data we collect and how we use it

This information is presented to you in conformity with 15 U.S.C. 6801-6810 and the Securities and Exchange Act of 1934 as amended by 15 U.S.C. 6801-6810. The nonpublic personal information which identifies you and your account is hereafter referred to as “personal information”.

All financial companies need to share customers’ personal information to run their everyday business. In the section below, we list the reasons financial companies can share their customers’ personal information; the reasons BKLN (“The Platform”) chooses to share; and whether you can limit this sharing.

You must be 18 years or older to register to use the Service. In addition, our Platforms are not designed or intended to be attractive to use by children under 13 years old, and we do not knowingly collect personally identifiable information from anyone under 13 years old. IF YOU ARE UNDER 13 YEARS OLD, PLEASE DO NOT USE ANY OF OUR PLATFORMS AT ANY TIME OR IN ANY MANNER. If you learn that your child under 13 years old has provided us with personal information without your consent, please contact us. We will delete that data from our systems.

We share your personal information only for the following two purposes: (1) For our everyday business purposes, such as to process your transactions, maintain your account(s), respond to court orders and legal investigation, or report to credit bureaus and (2) For our marketing purposes, to offer our products and services to you

We do not share your information for joint marketing with other financial companies or with any affiliates or non-affiliates.

Maintaining the security and confidentiality of your personal information is a BKLN priority. We take precautions to safeguard client personal information at all times, and we will remain vigilant in protecting that information. The following information will explain our privacy policy in more detail.

Information we collect:

  • Information from you

    • Information you provide on an application for an account, or any other financial product or service, whether in writing, in person, by telephone, electronically or by any other means, such as your name, email, address, social security number, assets, income and debt; and

    • Information we obtain for the purpose of tax reporting to you and the various agencies to which we report as required by law, including disclosures on various Internal Revenue Service (IRS) forms that we collect for tax reporting purposes.

  • Information about your transactions with us

    • Information that relates to account balances, payment history, trading activity and any other such transactions for which BKLN provides investment advice and direction. Trading information shared by users via the social features will be considered public information and not subject to this privacy policy.

    • Banking Information. To use the Platform, you will be asked to provide information regarding your banking relationship, including the bank name and your account number, bank routing number, and bank account login credentials.

    • Information we collect as part of authentication for purposes of servicing your account in a secure and confidential fashion; and

    • Information we collect through Internet “cookies” (an information collecting device from a web server).

    • When you use the Platforms, we may record certain details about your computer or mobile phone, the name of your Internet Service Provider (ISP), your IP Address, the website from which you visit us, the pages on our Platforms that you visit and in what sequence, the date and length of your visit and other statistical information about your visit to the Platform.

  • Information about your transactions with nonaffiliated third parties

    • Information provided to other nonaffiliated third parties as required by law, including information shared in connection with a subpoena or other legal document compelling our compliance; and

    • Information related to servicing your account for purposes of providing clearing services.

  • Investment Information: When you register to use the Platform, you will be asked to provide information regarding your investment preferences, including your risk tolerance, investment objectives and experience, time horizon, liquidity needs, and the like.

Methods of Collection and Data Usage: We use the aforementioned information to:

  • Fulfill your requests for information and to improve bug reporting and user issue resolution;

  • Analyze the use of our site, app, and services for our purposes, such as product and service enhancements;

  • Research and develop new products and services;

  • Authenticate you;

  • Secure and improve our network and services;

  • Detect and prevent potentially prohibited, fraudulent or illegal activities and otherwise in accordance with our Terms of Use; and for any other purposes disclosed to you at the time we collect your information or with your consent

3rd Party Data Usage: BKLN works with Apex Clearing to establish your brokerage account and thus will securely send your personal data to their SKETCH identity confirmation system. We will specifically collect the users legal name, date of birth, social security number, citizenship status, and address; as well as requested disclosure requirements such as whether they are a control person or not, a politically exposed person, and if they have any affiliation with FINRA. We also work with Plaid to securely connect your bank to your brokerage account. Their authentication system connects to your bank login and requires multi-factor authentication for added security. For more information about their privacy policy, click here.

Communications: When you initially sign up by providing us with your email address, we may use your email to send you information about our services, promotions, newsletters, press releases, and/or new offers. We will use your email address and any other information you give us to provide you with the information or other services, until you ask us to stop (using the ‘unsubscribe’ instructions provided with each email communication).

Our chatbot help desk service is powered by Intercom. If you engage with the chatbot (located at the bottom right of the screen), we may keep records of the conversation for future reference such as training material or improving our quality of customer service.

We will never use your email address or other information to provide you with any unsolicited messages or information, nor will we share it with or sell, rent or lease it to any third party for such use.

Access: BKLN restricts access to your personal account(s) and information to those employees who need to know that information to provide products and services to you. We maintain physical, electronic, and procedural safeguards that meet or exceed industry standards to safeguard your nonpublic personal information. Third parties who have access to such personal information must agree to follow appropriate standards of security and confidentiality. Clients should be advised that in order to better serve you, telephonic communications may be recorded and monitored for quality control.

For purposes of understanding your California Privacy Rights, do we share information about you with third parties for their own direct marketing purposes?

No. We do not share information collected about you with our affiliates, or with any unaffiliated third parties, for their direct marketing purposes.

Business Transfer Policy

In the event that we are involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction. This Privacy Policy will apply to your information as transferred to the new entity. We may also disclose information about you to our corporate affiliates in order to help provide, understand, and improve our Services and our affiliates’ services, including the delivery of ads.

Data Retention

If you have an online account with us, you may close your account at any time by visiting the ‘Account Settings’ page for your account. As defined in our Terms of Use, if you are a Client of BKLN, you can choose to deactivate your account by closing your brokerage account. This would revert your access back to a Registered User, still able to use our tool and create and save AITFs. As a Registered User, you can further request account deletion which will delete all records of your data on our platform except for your created AITFs.

Dispute Resolution

If you have any complaints regarding our compliance with this privacy policy, you should first use our Intercom chatbot located at the lower left corner of the page or contact us at compliance@bkln.com. We will investigate and attempt to resolve complaints and disputes regarding use and disclosure of personal information in accordance with this privacy policy.

As a user you are entitled to request information on how your personal information is being used. Your request will be acknowledged within 10 days and fulfilled within 45 days of inquiry. If you have an unresolved privacy or data use concern that we have not addressed satisfactorily, please contact us at compliance@bkln.com.

Future Changes to Privacy Policy

We may update this Privacy Policy as necessary to reflect changes we make and to satisfy legal requirements. We will post a prominent notice of material changes on our websites. We will provide you with other appropriate notice of important changes at least 30 days before the effective date.

What law governs this Privacy Policy?

You agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the law of the State of New York, without reference to the choice of law or conflicts of law principles thereof, and will be subject to the dispute resolution clause contained in our Terms of Use.

If any provision of this Privacy Policy is judged to be illegal, void or unenforceable due to applicable law or by order of a court of competent jurisdiction it shall be deemed deleted and the continuation in full force and effect of the remainder of the provisions will not be prejudiced.
